Complete Guide: Residence Visa for Digital Nomads in Portugal
The emergence of remote working, especially for digital nomads, has become an even more evident reality following the challenges of the pandemic. Many of these professionals already enjoyed the freedom to work from anywhere even before the lockdown periods. However, even with this freedom, the need for a regulatory basis for permanent residence in Portugal has become essential.
Why Portugal?
In March 2022, Portugal won the title of best country to live, work and travel as a remote worker.
This recognition is due to the pleasant climate, quality of life, public safety and, especially, the internet infrastructure, which is vital for professionals in this category.
Despite the attractive scenario, until recently Portugal didn't have a specific visa for digital nomads, leading many to opt for the D7 visa based on their own income.
Law No. 18/2022: Creating a New Reality for Digital Nomads in Portugal:
In August 2022, Law No. 18/2022 established procedures for obtaining a residence visa, resolving the issue for professionals with subordinate employment contracts. This legislation reflects the portuguese government's commitment to recognizing the importance of immigration for economic and demographic development, guiding immigration policies towards regulated and sustainable integration.
How do I apply for a Digital Nomad Visa?
If you work remotely, you can apply for a residence visa at a consular post, embassy or through VFS Global, an entity accredited by the portuguese government. The process involves filling in a specific form and submitting the necessary documentation.
What documents do I need?
The list includes photographs, a valid passport, a criminal record, travel insurance, proof of means of subsistence, among other specific documents for dependent and self-employed workers.
Visa requirements for Digital Nomads:
For dependent workers, an employment contract and employer's declaration are required. For self-employed workers, company contracts, service contracts, proof of income and proof of tax residency are required.
After the Digital Nomad Visa has been granted:
After the visa is granted, a sticker is inserted into the passport, which is valid for three months. The next step involves submitting a residence permit, including additional documents, to AIMA - the Agency for Migration Integration and Asylum.
Family reunification:
Family members can be reunited on national territory, following the process set out by AIMA - Agency for Migration Integration and Asylum.
Digital Nomads already in Portugal: What to do?
If you are already in Portugal without the appropriate visa, follow the procedures set out in the Aliens Act. The procedure is more simplified and has a shorter waiting period than the expression of interest.
It should be noted that the Decree-Law regulating visas for digital nomads came into force on October 30, 2022.
